CONSPIRACY DEFINED

Conspiracy involves three elements: (1) an agreement between two or more people to commit a crime; (2) willing participation of the defendant to assist in execution of the offense; and (3) an overt act in furtherance of the conspiracy. It is important to note, therefore, that an individual may be charged with conspiracy even if he has not personally committed the offense or the offense itself was never fully carried out. What’s more, an individual charged with conspiracy to commit a crime is faced with the same penalties as if he had actually performed the act himself.

For example, you could be out on the corner with other people and while another is make drug transaction the police testify that you are looking up and down the street or riding a bike around the corner, they can arrest you for conspiracy to sell drugs arguing that you are the “lookout”.  Or, you could exchange money with someone who is selling drugs on the corner and you get stopped with a large amount of money and police believe that you are getting drug money off the corner and are therefore part of the conspiracy.  You could be held responsible for acting as a co-conspirator if you are sitting in a car while another person robs a corner store and even shoots and kills someone inside and the person gets in your car after the crime and you drive away.  You could be considered the “get away driver” and you could be responsible for everything that happened inside the store even though you never entered the store.
